This study conducted comparative research on the current situation and issues of LGBT-related laws and policies in five countries and regions: South Korea, Taiwan, China, Hong Kong, and Japan. LGBT-related laws and policies in each country and region have developed through repeated trial and error in the areas of same-sex marriage, legal gender alteration, and anti-discrimination, based on the historical and social positioning of the legislative, judicial, and administrative branches. Although searching for commonalities of internal and external factors in development still requires careful and detailed examination, we have confirmed that human rights protections and the perception of state responsibility toward them, as well as general perceptions of human rights, including civil society, can be important factors.

Throughout the research period, 11 study meetings were conducted, and their outcomes were published on the website. In addition to research and studies conducted Research and studies conducted domestically and abroad, research findings have been presented at domestic and international academic conferences. The book titled "Business and Human Rights: Dynamics of Norm Formation and Dissemination from an International Human Rights Perspective (tentative)" is scheduled to be published by Nihon Hyoron Sha Co., Ltd. in September 2024. In this book, after outlining the overall picture of dynamic phenomena captured by "business and human rights" (Part 1), the developments in the international community (Part 2), and acceptance in domestic society (Part 3) are examined theoretically and empirically, along with analysis and discussion of progress and challenges from the perspective of stakeholders' rights in international human rights law (Chapter 4).

In this study, in order to examine the overall awareness and determining factors regarding sexual minorities, a nationwide survey on Sexual Orientation and Gender Identity (SOGI) awareness targeting individuals aged 20 to 79 was conducted in June 2019 (hereinafter referred to as the National SOGI Awareness Survey). Based on the aggregated results, the overall awareness landscape in Japan was presented. Among these, by ensuring the consistency of the questionnaire items with the National SOGI Survey conducted in 2015, it became possible to observe the longitudinal changes in awareness from 2015 to 2019.

This research aims to promote the application of international human rights standards through the comparative study of LGBTQ-related laws and policies and to build a theoretical foundation for the realization of human rights. As a result of the comparative study of four countries, the Netherlands, the United Kingdom, Germany, and Australia, the following three-point has been found; (1) the dynamic linkages among domestic institutions, civil society, and international and regional organizations in application of international human rights standards, (2) the effective use of legally binding human rights treaties and other non-binding instruments, and (3) the human dignity and personal autonomy plays a core role for realization of human rights related LGBTQ.

This research undertook to explore the status of domestic implementation of the UN Convention on the Elimination of All Forms of Discrimination against Women, which Japan ratified in 1985, or to what extent the Convention was complied with. The UN Committee on the Elimination of Discrimination against Women, the Convention's monitoring body examines the periodic reports submitted by the Japanese government, and issues its Concluding Observations. In the research, the background and the status of discrimination in Japan that were indicated in the " principal areas of concern" and "recommendations" in the Observations were examined regarding the domestic implementation of the Convention, in order to conduct a comprehensive analysis covering domestic legal system, policy, judiciary, history, culture and society, and clarify the factors hindering the full implementations of the Concluding Observations in Japan.

In Japan, there is only one law related to "gender diversity", including LGBTQ and others, and that is the Special Act on Gender Identity Disorder (referred to as the "Special Law"). However, the Special Law has been criticized for being too strict in its "gender reassignment requirements," including from a comparative legal perspective. Internationally, many countries have one of the following legal systems for same-sex marriages. (1) Marriage laws that allow marriage regardless of gender. (2) The partnership law. Japan is the only country among the G7 countries that does not have either of these legal systems. This study investigates the legal systems of advanced countries in this field, such as Scandinavian countries, and the trend of the United Nations, and suggests implications for Japan. In addition, we have conducted research and surveys on the family, legal gender reassignment methods, school education, and treatment of sexual minority prisoners, then we made recommendations.

This research approaches on right security of a sexual minority from employment and labor side and aims the findings of the legislative and personnel policies to which are raised on the labor law based on a fact investigation. The outcomes of this research are as follows. (1) I researched on the real states of LGBT persons, the policies of the advanced enterprises and an LGBT in the foreign countries and elucidated that the law is indispensable for human rights protection of LGBT persons.(2) On these findings I raised the themes of human rights protection of the sexual minority such as a necessity of law enactment, the concrete contents and the important notices of personnel policies.

It is clear global trend to promote human rights of LGBTQs in this decade. This study elaborated these human rights from the viewpoint of dignity and equality, and examined the current situations and issues of laws and policies regarding LGBTQs in Japan. Many of these has been created from the perspective of economic benefits and protection of the weak, not from the comprehensive human rights protection. In this point, the precedents of international human rights standards and recommendations from international organizations and treaty bodies clearly show what should be done by government for realization of human rights of LGBTQs.

This research project produced a book entitled, "Cultural Diversity in International Law- from the perspectives of human rights and development." The book attempts to analyze the significance of cultural diversity in in international human rights law and the international law of development. The target of the research relates to the analysis of the UNESCO Convention on Cultural Diversities, and other international human rights treaties concluded by the United Nations and the Council of Europe.
The book is composed of the articles written by thirteen contributors of international and constitutional law. The articles relate to various problems such as the right of equality of the ethnic minority people, indigenous people, the people of LGBTs, the rights of women, and other problems concerning the local implementation of international criminal law in the African countries and etc. -

In our research group, in March 2015 the survey cluster implemented the quantitative survey all over Japan using formal methodology. The policy cluster conducted exhausted survey to the local governments on how they implement policies for sexual minorities within the gender equal society and human rights fields in May 2016. To accomplish the projects, we got the suggestion on making questionnaire, wording and communication methods when the results are disclosed. And we organized conference for showing the results of this survey at Tokyo and Kyoto. Moreover we published “Attitudes toward Sexual Minorities in Japan: Report of 2015 National Survey” on the Website of the representative researcher.

The aim of this research project was to further develop queer studies in the Japanese context by looking at the intersection of sexuality, gender, class, race, ethnicity, region, and nationality. It was found that a number of studies on the Japanese legal system, social survey, and institutional design relevant to queer concerns have thus far been conducted without having a productive merger between their empirical research and theoretical investigations. It was therefore recognised that it is of utmost importance to make this project’s findings have critical dialogues with the concerns of diverseacademic disciplines as well as the general public.

This study analyzes international human rights law aiming to eliminate sex/gender discrimination and considers the potential for and limits on the protection of human rights with regard to sexual orientation and gender identity(SOGI). It demonstrates that there are three different directions regarding the treatment of SOGI in the context of human rights :(A) interpreting SOGI as an issue of sex/gender,(B) treating SOGI as merely one kind of discrimination or vulnerability issue, and/or(C) defining SOGI as a new category. Even as these may seem incongruous, when we consider the ways they are used in human rights discourse as well as put into practice, it is clear that these three developments are in fact complementary.

Research was conducted to account for the feasibility of applying Anglo-American based Queer Studies to Japan's culture and society. As a result, the following points were confirmed : it is imperative to consider the relationship between nationalism and globalization in the political and cultural government and regulation of gender and sexuality ; research needs be conducted from a frame of reference that posits sexuality and gender as intersecting with axes of social positioning, class, race/ethnicity, regionalism and nationality.

本年度は以下の3点について研究を遂行した。
(1)法的保障ニーズ調査結果の公表
過去2年間の同性カップルの法的ニーズ調査につき、2007年12月15日に「同性カップルの生活と制度:聞き取り調査から考える現在と未来」と題するシンポジウムを開催し、発表を行った。シンポジウムでは、類似の調査を行う研究者とともに登壇し、ゲストスピーカを交えて、日本の同性カップルのおかれる現状と法的ニーズの問題点を議論した。
(2)海外における研究成果発表と研究交流
本年度は3回の国外出張を通じて、日本の性的マイノリティの権利保障状況を報告するとともに、諸外国の研究者との意見交換を行った。2007年11月にインドネシア・ボゴールにおいて開催されたLGBTの教育に関する国際会議で報告を行い、2008年1月にタイ・チェンマイおよびオーストラリア・メルボルンで開催されたLGBTに関する国際人権会議に参加し、パネルディスカッション等を通じて、海外の研究者・活動家と意見交換を行った。
(3)研究成果のまとめ
3年間のまとめとして、本年度は2冊(性的マイノリティに関する国際判例集、性と人権ブックレット)の執律・編纂に着手した。ブックレットは2008年9月、判例集は2009年3月に刊行を予定している。 -

The last quarter of the 20th Century experienced a significant change in international legal order with gender at its center as shown in a series of international conferences organized by the UN. The Convention on the Elimination of All Forms of Discrimination against Women (Women's Convention) and its Optional Protocol, among others, shall be acclaimed for they have provided tools to re-construct international legal order from a gender perspective. This research tried to construct a feminist international jurisprudence using gender perspective and the Women's Convention.
This research was a collaboration of 20 investigators and 10 research associates over the two years from April 2001 to March 2003. Chapter 1 showed the change of international law and international relations required by both academic and social developments of feminism. Chapter 2 examined the adopting process, contents, and future possibility of the Optional Protocol for it symbolized the structural change of international law. Chapter 3 studied how women's human rights have been incorporated into the practice of other UN human rights treaty bodies as well as regional human rights organs. Chapter 4 examined gender perspective introduced to national laws in several countries. Chapter 5 proposed a prospect for the future in regard to Japan's ratification of the Optional Protocol. In addition, the group studied and translated a book by Hilary Charlesworth & Christine Chinkin, The Boundary of International Law: Feminist Analysis (Manchester University Press, 2000) into Japanese for it provides basics for feminist international jurisprudence.
