2021年度は、5回の研究会を実施した。4月24日には、深山（研究分担者）が「ニュージーランド博物館 テ・パパ・トンガレワの歴史と現在」、小坂田（研究代表者）が「差別の歴史展示を博物館の役割」と題する報告をそれぞれ行なった。7月10日には、小坂田が「アイデンティティの多様性と博物館展示」と題する報告を、石原真衣氏（北海道大学アイヌ・先住民研究センター助教）が「サイレントアイヌ 排除の暴力／包摂の暴力」と題する報告を行なった。10月23日には、立石（研究協力者）が「国立アイヌ民族博物館における「議論の場」の構築に向けた実践的試み」と題する報告を行なった。11月13日には、小坂田が「博物館展示における先住民族との協働―国立アイヌ民族博物館と国立アメリカ・インディアン博物館の比較」と題する報告を、北原次郎太氏（北海道大学アイヌ・先住民研究センター准教授）が「国立アイヌ民族博物館での展示制作とアイヌ語表記作成における経験について」と題する報告を行なった。3月26日には、野口泰弥氏（北海道立北方民族博物館学芸員）が「ラポロアイヌネイションと展示をつくる」と題する報告を、持田誠氏（浦幌町立博物館学芸員）が「浦幌町立博物館とアイヌ展示」と題する報告をそれぞれ行なった。
2021年度には、複数の博物館でのアイヌ展示の調査も行った。7月9日には、小坂田が国立アイヌ民族博物館を訪問、7月11日には、小坂田、深山、山崎（研究協力者）、岡田（研究協力者）で、「旭川市立博物館」と「川村カ子トアイヌ記念館」に訪問した。11月12日には小坂田が国立アイヌ民族博物館にて特別展示「ビーズ アイヌモシリから世界へ」を、11月14日には、小坂田、深山、立石が北海道博物館にて「企画テーマ展 アイヌのくらし―時代・地域・さまざまな姿」の調査を行った。

The Nagoya Protocol, which is one of multilateral environmental agreements, has close inter-linkage with other international instruments, including law of the seas, human rights law and international economic law, since the purpose of the protocol is the benefit sharing of genetic resources. The current global environmental issues tend to have a great influence upon the other legal regime because of its diversity and complexity. The same trends can be seen in the climate change regime such as the Kyoto Protocol and the Paris Agreement and it is said that they could provide an significant impact of a fragmentation and integration of international law.

Our research has revealed that in the context of international environmental law, international development law and international economical law, there are some cases where indigenous peoples are allowed to participate in the process of making a law which might affect them and that, on one level or another, there exists a growing awareness of the importance of respecting their rights in implementing laws. We couldn't find, however, sufficient accumulation of state practices to prove the structural conversion of state-centered international law.
Our research also has shown that some local and national administrative bodies referred to UN declaration and occasionally used it to justify their policies concerning the Ainu. At municipal level, however, this tendency can be seen only in a few local areas where relatively many Ainu people live. Besides, there is no case where the UN declaration fundamentally changed the existing national and local policies toward the Ainu.

First, this research has revealed two approaches to recognize indigenous peoples' land rights under international human rights. One is to emphasize the special relationship between indigenous peoples and their lands, the other is to approve their rights to restitution or compensation for their traditional lands which have been unreasonably deprived of. Secondly, this research indicated there is a danger that the subject of indigenous peoples' land rights in Africa will expand unlimitedly. This is because the concept of indigenous peoples, which was traditionally understood in relation to the colonialism, has been broadened to be applied to ethnic minorities in Africa, and besides, by taking the former approach, the status of pre-invasion is not necessarily required as the condition of indigenous peoples' land rights.

2008年度は、まず、昨年度に引き続き先住民族の土地に対する権利について研究をおこない、論文を神戸法学年報第24巻(2009年3月発刊予定)に提出した。本研究の検討から、米州における先住民族の土地に対する権利に関して、次のような発展が認められた。第1に、米州宣言議長草案でIACHR草案では承認されなかった先住民族の自決権が規定され、作業部会第11会合まで当該条項は維持されたまま審議が進められていること。第2に、Awas Tingni事件判決以降、米州人権裁判所は先住民族の土地に対する集団的財産権を承認し、土地の境界画定及び権原付与を命令する実行が確立しており、先住民族の土地での資源開発許可についても他の国際及び地城的人権条約実施監視機関より厳しい基準を設定している。このような発展が米州で可能となった背景として、90年代の経済成長にもかかわらず貧富の差が拡大した結果、反ネオ・リベラリズムを掲げる先住民族組織が、2000年代のラテンアメリカの多くの国家及び地方政治においてますます発言力を強めていることがある。しかしこのような規範面での発展にも関わらず、実際には先住民族の土地に対する権原付与はラテンアメリカの多くの国でおこなわれておらず、米州人権裁判所による権原付与命令も完全履行された例は存在していないことを指摘した。
次に、国連宣言における先住民族の土地に対する権利を中心として研究をおこない、講座国際人権法第4巻(2009年8月頃発刊予定)に提出した。ILO第169号条約と比較した場合の国連宣言の特微としては、自決権の挿入及び先住民族の定義の欠如に加えて、第1に、過去に占有していたが先住民族の説明を受けた上での事前の自由な同意なくして剥奪された伝統的土地等について、「返還」を含む救済を受ける権利が認められたこと、第2に、土地と天然資源の権利が分けて規定されておらず、土地に対する権利については、現に排他的に占有しているか否かで権利内容が区別されることなく、所有・使用・開発・管理の権利という包括的な権利が認められていること。また伝統的土地に存在する天然資源について、国家に所有権が帰属している場合に別段の考慮がなされることなく、土地と同じく包括的な権利が認められている。第3に、国連宣言第29条自体は開発計画の承認に先立つ関連先住民族との協議を義務づけているだけではあるが、第28条が先住民族の伝統的土地及び資源に関して、説明を受けた上での事前の自由な同意なく損害を被った場合に補償を受ける権利を規定しているため、両条項を合わせて読むと事前の同意までが要求される結果となっていること、を指摘した。
