The German Civil Code(Buergerliches Gesetzbuch) provides joint custody concerning children born out of wedlock, which adopted through the Parentage Law Reform Act in 1997 and amended by the Reform Act in 2013. It is the purpose of this study to analyze the German case law and a report of practical experiences which assessed by the Department of Justice. The new law introduced the simplified procedure into the German Family Procedural Law. In judical practice, this procedure is applied effectively, but so many judges criticize new system because parents are not heard in person. The German experience ought to be instructive for Japanese Family Law which dose not assign joint custody to unmarried parents.

The purpose of this study is to investigate the needs of orphans and children who need care in disaster and to survey activities of support groups for children with the method of sociology and statistics. Based on this study, we analyzed the legal custody of guardians and foster parents. Thereby we suggested the legal platform to corporate with guardians, foster parents and support groups for children.

Japanese family law does not assign joint parental responsibility to unmarried parents, even if they live together with their children. On the other hand, the German Civil Code provides joint custody system concerning children born out of wedlock (Sorgeerklaerung), which adopted through the Parentage Law Reform Act in 1997. The purpose of this study is to analyze the historical development of unmarried-parental responsibility in Germany and to propose a new approach how to introduce the corresponding system into the Japanese law. For this purpose, this study adopts a method of historical research on German family law. It is significant that the theoretical discussion preceding the introduction of unmarried-parental joint custody system into the German Civil Code was lively. It became clear that there are many important factors to determine reformation of custody system for children born out of wedlock.

I have compared japanese adoption law with USA(Massachusetts),german,french,austrian,italian and New Zealand etc. adoption and its related law. After the introduction of special adoption in Japan 1988,there is few discussion for a reform of adoption law in Japan. But this reserch has tried to prove the necessity for a reform of japanese adoption law. Here the adoption law isn't only the adoption law in civil code, but also child wellfare law, family case procedure and adoption service law.
