    As is shown in the provisions on the categories of EU competence which was introduced by the Lisbon Treaty, there are some asymmetries between certain policies in terms of competence allocation in the EU, such as those ⒜ between monetary policy and economic policy, and ⒝ between internal market and social policy. The asymmetry ⒜ has prevented the EU from responding quickly to the European debt crisis, while in the asymmetry ⒝ negative integration by free movement of goods, persons, services and capital has often made national social policies malfunction, with little social harmonisation at the EU level. The Lisbon Treaty has not necessarily offered satisfactory solutions for such asymmetry problems.<br>In order to explain the asymmetry problems, the "triangular model of European economic integration" is presented. The author modifies Dani Rodrik's hypothesis of "the political trilemma of the world economy" to apply it to the EU. The following explanation could be theoretically made. The assumption is that it is impossible to achieve economic integration, sovereignty and democracy at the same time. Consequently, there are three options. ⑴ Provided that states choose economic integration and democracy, harmonisation will be made under supranational democracy. To that extent, national sovereignty will be lost (the situation of "European federation"). ⑵ Provided that states choose economic integration and sovereignty, regulatory competition, for example, will be brought about under (pure) mutual recognition, and the market, not national political process, will decide the rules. To that extent, domestic democracy will be lost (the situation of "the Golden Straitjacket"). ⑶ Provided that states choose sovereignty and democracy, it will lead to national treatment. State autonomy and national democracy will be retained, but economic integration will be harmed.<br>This model is an ideal type. In reality, it can be said that the deeper market integration goes, the more difficult it will be that sovereignty and democracy are achieved at once in a given area. And the three situations ⑴-⑶ can take place at once among different areas, as is seen in the Internal Market and also in the Economic and Monetary Union within the EU.<br>The "triangular model of European economic integration" implies that, as European integration develops further, national democracy would be more difficult to maintain and that consequently the choice would have to be made between "European federation" and "the Golden Straitjacket" by the EU Member States, who seem to prefer the latter.

    (1) Monetary Union v. Economic Union<br>Does EMU mean "European Monetary Union" or "Economic and Monetary Union"? The relationship between the Monetary Union and the Economic one is asymmetrical. According to the EC Treaty, the Monetary Union means the European System of Central Banks (ESCB) which is the one single decision-making centre in the monetary field. On the other hand, in the Economic Union, the ultimate decision in the fiscal and budgetary field remains in the hands of the Member States and they monitor their economic policies mutually in the Econmics and Finance Council (ECOFIN) through the multilateral monitoring procedure and the excessive deficit procedure, reinforced by the Stability and Growth Pact.<br>(2) ECB v. ECOFIN<br>The foreign exchange rate policy belongs exlcusively to EMU. Article 111 [ex. 109] (1) stipulates that ECOFIN has the power to conclude formal agreements on an exchange rate system for the Euro in relation to non-Community currencies. However, under the floating exchange rate system, ECOFIN may only formulate "general orientations" for the exchange rate policy to those currencies. It means that the primary objective of ESCB to maintain price stability has priority over "genaral orientations", which seem not to be legally binding.<br>(3) "Ins" v. "Outs"<br>Even the non-participating Member States in the Euro participate partially in ESCB, because these countries are members of the General Council, and they have the obligation to achieve the independence of each national central bank (NCB), with the exception of the UK.<br>(4) ECB v. NCBs<br>ECB decides monetary policies and NCBs implement them. This reflects centralisation. But the other elements indicate that ESCB has a decentralised structure. First of all, the govenors of NCBs are members of the Governing Council, in which each of them has one vote, in addtion to the members of the Executive Board, and decision-making is in principle by simple majority. Secondly, NCBs may perform functions other than those in the ESCB Statute in so far as they interfere with the objectives and tasks of ESCB.

    (1) On the one hand, the aspect of free movement of persons in the 3rd pillar has been moved into the 1st pillar (EC), though it is incomplete and includes certain opt-outs. On the other hand, the external aspect (TEU Articles K. 9 and K. 10) of the 3rd pillar (Police and Judicial Cooperation in Criminal Matters: PJCC) has been made subject to the provisions (TEU Articles J. 8, J. 9 and J. 14) of the 2nd pillar (CFSP). This means the "2nd pillarization" of the 3rd pillar in respect of external relations, while the 3rd pillar (PJCC) will not be completely "communitarized" even in the long term.<br>(2) The legal personality of EU as such has not been expressly provided for in Treaty of Amsterdam. However, there are some arguments, among the Member States, for the existence of the so-called objective legal personality of EU, and the Council has become able to conclude international agreements by unanimity, which competence the Commission calls a "mini-personnalité". In addition, the Protocols (on TEU Article J. 7 and the Schengen acquis) in Treaty of Amsterdam provide that certain specific agreements will be concluded in the 2nd and 3rd pillars. EU could have a full-fledged legal personality in the fields of CFSP and PJCC in the near future, which will require adaptation in relation with the legal personalities of the 3 Communities, particularly that of EC.<br>(3) Apart from TEC Article 113 (5), Title III a of TEC on free movement of persons could be interpreted as being capable of giving EC certain exclusive competence to conclude international agreements on services in the light of ECJ's Opinion 1/94 re WTO, irrespective of Protocol No. 8 on Article 73j (2) (a) and Declaration No. 18 on Article 73k (3) (a).<br>(4) There may be some criticism that, in the fields of Title III a of TEC and PJCC, ECJ has not been given the normal jurisdictions like those in the existing EC matters, because it might affect the uniform interpretation by ECJ of EC Law as a whole. However, despite that deficit, there is considerable progress in terms of increasing judicial control, compared with the present provisions of TEU. And one can even say that a preliminary ruling of ECJ in PJCC could be some guideline on similar questions for interpretation by the national courts of the Member States who will not accept that jurisdiction of ECJ.<br>(5) On the "Closer Cooperation" clauses, ECJ should have been conferred a competence like that in TEC Article 228 (6) to give a legally binding opinion on the compatibility of the introduction of such a cooperation with the Treaty provisions prior to a decision to adopt it.

    Through this research project from 2002 to 2006, the policy developments and coordination among member countries of the European Union and those of the Organization for Economic Cooperation and Development have been focused on. Legal Coordination of the relevant countries for free movement of capital has significant influence over substantially any legal field and activities of member countries, as well as those of the international organizations. Especially, for our research project, domestic tax system, international taxation, financial regulations, mutual assistance in criminal matters seemed faced with serious infringement of cooperative policy coordination among countries.
    European Court of Justice have ever treated cases relating to taxation, financial regulation and other related matters under its authorities given by the European treaties, and determined some national legislations to be violation of European law. This tendency could be observed in tax, finance and criminal fields under common understandings of relevant EU Law.
    Fiscal Committee, OECD has revised their Model Tax Convention on Income and on Capital, in 2000,2003 and 2005. Through these revisions, the texts of the Convention become ready for effective administration of international tax system through the Convention. The treatment of the Permanent Establishments and the income from dividends or other distributions of corporate profits become more liberalized one, exempting source taxation of specific types of income or allowing treaty partners to tax items of income with lower rate of tax.     (1) During last three years, Europe has undergones sweeping changes: The introduction of the common currency (EURO) in January 1999, three additional countries' membership to NATO in 1999, the opening of the EU accession negotiations, and the beginning of the EU's Inter-Governmental Conference (IGC) in February 2000. During the negotiations of the last IGC, the institutional reform was unsuccessful. The European Union itself took a big step in term of Common Security and Defence Policy. It decided to conduct crisis management which includes deploying forces.
    This is a significant departure from a "Civilian Power."
    (2) Japan and Asia were in a deep economic and financial crisis. Europe's commercial interests in Asia faded away. When Asian countries' economics entered a recovery process, Europe showed interest again. The Asia-Europe Meeting (ASEM) process has continued by convening various level's conferences, which multuplied meeting opportunities between Asia and Europe.
    (3) Because of economic and financial crisis in Asia and the heavy agendas of the European Union. Europe's relations with Asia, region-to-region dialogue, have not fully developed yet, as was expected in early 1997. In terms of Japan-EU bilateral relation, the EU side indicated its interest in having deeper political dialogues since serious trade frictions were over. In Mr. Kono's speech in January 2000 in Paris, Japan started to active it policy toward Europe. In view of the Okinawa G8 summit meeting, Japan needs to rezctivates its dialogues with Asian countries, and to bring an Asian dimension to the summit
    (4) Three European scholars have contributed a lot to this study project. We exchanged views and information many times in Japan and in Europe. Keiso shobo is to publish the outcome of this research project

    The purpose of this study project is to clarify the dynamics of European integration process in the chaning world. In the post Cold War era, how to built a new European architecture is a crucial issue among the European countries in which the European Union is expected to play a mejor role. But the EU is faced to so called "deepening and widening" problem : on the one hand, the prospect for the Economic and Monetary Union (EMU) and further political integration are still unclear and on the other hand, Central and Eastern Euroepan countries are so eager to be member of the EU as soon as possible. And as a supranational body, the development of the EU integration will bring certainly a new type of interstates cooperation in the place of traditional Nation-state system. Concidering these problems, this project try to analyze the present situation surrounding the EU from diverse points of view and to examine the future couse of European integration in the 21st century.
    The study group is composed of 8 Japanese reserchers and 3 Euroepans. All of them had carried out research trips on the following topics : deepening and widening of the Euroepan Union ; Economic and Monetary Union ; EU's policy towards Central and Eastern European countries ; EU and Nordic countries ; EU policy of France, Germany and United Kingdom ; Common Foreign and Security Policy (CFSP) ; European security ; Cooperation in the fields of justice nad home affairs ; role of the European Commission and the Coundil in the EU ; Council of Europe ; World Trade Organization and EU ; EU-US relations.
