    This paper offers insights into the foundational principle that the state should adhere to when assigning parents to children, particularly focusing on the normative relationship between procreation and parental license.

    Undoubtedly, children’s welfare and their entitlement to appropriate parenting is vital when formulating parent allocation laws. Anca Gheaus advocates for a reevaluation of these laws based on the Best Available Parent principle, which asserts that parental licenses should be granted to the person(s) anticipated to provide the most suitable care among all parent candidates. Accordingly, the state should allocate parental licenses to candidates deemed more qualified, even if the procreators wish to raise their child. Many people seem to find this implication counter-intuitive because the state should be granting parental licenses to procreators.

    Harry Brighouse and Adam Swift assert that procreators have a right to parent their children, and the state must consider children’s rights and procreators’ right to parent when assigning parents. If this style is considered, the state should initially allocate parental rights to procreators. This paper critically examines their arguments and posits that the interests of adults in parenting should not supersede the BAP Principle in parental allocation decisions.

    Michael Austin asserts that procreators are duty-bound to parent their children. He argues that if the state allocates parental licenses to individuals other than the procreators, it would erroneously exempt the biological parent from their duty without sufficient justification. This paper reveals that Austin’s argument relies on the BAP principle when connecting procreators’ responsibility to parental obligation, contending that the Procreators’ Responsibility Account of Parental Obligation can be reduced to the BAP principle.

    This paper advocates for the reconstruction of the parent allocation system based on the BAP principle. However, it raises some objections to Gheaus's argument, particularly the assertion that the person gestating a child is often its BAP.

    This presentation belongs to the field of political philosophy and examines the institution of marriage through feminist and queer theoretical perspectives, with a focus on the movement for the legalization of same-gender marriage in Japan. While the push for same-gender marriage rights is often framed as a matter of equality, this study critically investigates whether expanding the marriage institution truly advances the rights of sexual, gender, and romantic minorities. The presentation also engages with the development of political philosophy in Japan, where local scholarship has evolved while being shaped by debates that have emerged in the context of the UK and the US. By building on this body of research, the study connects local legal and philosophical discussions to broader international frameworks.
    A key component of this analysis is a critical examination of recent legal decisions by Japanese district and high courts regarding same-gender marriage. The presentation evaluates the reasoning behind these rulings from a political philosophy perspective, questioning whether these judgments reinforce or challenge prevailing societal structures. Drawing on feminist critiques of the patriarchal foundations of marriage and queer theories that question the normativity of state-sanctioned, monogamous relationships, this study explores whether the legalization of same-gender marriage in Japan can act as a tool for social transformation or if it merely upholds existing power dynamics. By addressing these issues, the presentation seeks to deepen our understanding of how legal reforms interact with autonomy, recognition, and resistance in the feminist and queer contexts.

    The purpose of our research is to construct a new philosophical foundation of ‘global legisprudence’ by developing and integrating the theoretical resources of legisprudence and global justice. We revealed that the conventional theories of legisprudence which almost exclusively focused on domestic legislation could not appropriately deal with the problems that domestic legislation and global order formation interacted with each other. Then we presented some guides for division of labor between domestic legislation and global law-making, and explored how to guarantee democratic accountability of both. Thereby we built a philosophical foundation of global legisprudence.
